Terms of Service

1. Acceptance of Terms

By accessing or using VoteFlip ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or in-app notification.

2. Eligibility

You must be at least 13 years old to use VoteFlip. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. By using VoteFlip, you represent and warrant that you meet these requirements.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Promptly update your account information if it changes
• Accept responsibility for all activity that occurs under your account
• Not create more than one account per person

You may sign in using third-party providers (Google, Apple, Facebook, X). By doing so, you authorize us to access certain information from those services as described in our Privacy Policy.

4. User Content

"User Content" means any polls, comments, votes, profile information, and other content you submit to the Service.

• Ownership: You retain ownership of your User Content. By posting content, you grant VoteFlip a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the Service.
• Responsibility: You are solely responsible for your User Content and the consequences of posting it.
• Removal: You may delete your polls and comments at any time. We may retain anonymized or aggregated data (such as vote counts) after deletion.

5. Acceptable Use

You agree not to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity, or misrepresent your affiliation
• Use the Service to spam, solicit, or send unsolicited messages
• Manipulate votes, create fake accounts, or use bots or automated scripts
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or its infrastructure
• Collect or harvest user data without consent
• Use the Service for any illegal purpose

6. Reputation & Gamification

VoteFlip includes a reputation system, achievements, and streaks. These features are provided for engagement purposes. Reputation points, badges, and leaderboard rankings have no monetary value and cannot be transferred or exchanged. We reserve the right to modify the reputation system at any time.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by VoteFlip and are protected by international copyright, trademark, and other intellectual property laws. The VoteFlip name, logo, and branding may not be used without prior written consent.

8. Termination

We may suspend or terminate your account at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may delete your account at any time through the Settings page. Upon termination, your right to use the Service will immediately cease.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free. Poll results and user-generated content reflect the opinions of individual users and do not represent the views of VoteFlip.

10. Limitation of Liability

To the maximum extent permitted by law, VoteFlip shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
